1. Agreement to Terms

By downloading, installing, or using Offroad Buddy ("the App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App.

These Terms constitute a legally binding agreement between you and Offroad Buddy ("we," "us," or "our") governing your use of the App.

2. License to Use

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to:

• Download and install the App on devices that you own or control
• Use the App for personal, non-commercial purposes
• Access and use features as described in the App documentation

This license does not permit you to:

• Modify, reverse engineer, decompile, or disassemble the App
• Remove, alter, or obscure any copyright, trademark, or other proprietary notices
• Use the App for any illegal or unauthorized purpose
• Distribute, sell, or sublicense the App
• Use the App to create a competing product or service

3. Subscriptions and Payments

Offroad Buddy offers both free and Pro subscription tiers.

3.1 Free Tier

The free tier provides access to core tracking features with limitations on vehicle count and path history.

3.2 Pro Subscription

Pro subscriptions are purchased through Apple's App Store and are subject to Apple's Terms of Service. Subscription fees are charged to your Apple ID account.

• Billing: Subscriptions automatically renew unless canceled at least 24 hours before the end of the current period
• Cancellation: You can cancel your subscription anytime through your App Store account settings
• Refunds: Refunds are handled by Apple according to their refund policy
• Changes: We reserve the right to modify subscription pricing with 30 days notice

3.3 Free Trial

We may offer a free trial period for Pro features. If you do not cancel before the trial ends, you will be charged the subscription fee. Trial eligibility is at our discretion.

4. User Content and Data

4.1 Your Content

You retain ownership of all data you create using the App, including:

• GPS tracks and waypoints
• Vehicle information and photos
• Path metadata (names, descriptions, photos)
• User profile information

By default, all your content is stored locally on your device. We do not access or store your local data on our servers.

4.2 Shared Content

If you choose to share paths with the community (Pro feature), you grant us a worldwide, non-exclusive, royalty-free license to:

• Store and display your shared paths to other App users
• Use shared content to improve the App and community features
• Remove shared content that violates these Terms

You can delete shared paths at any time. Once deleted, we will remove them from public view, though they may remain in backups for up to 30 days.

4.3 Content Standards

When sharing content, you agree not to:

• Share paths on private property without permission
• Include offensive, inappropriate, or illegal content
• Violate any person's privacy rights
• Infringe on intellectual property rights
• Share inaccurate or misleading information

5. Acceptable Use Policy

You agree to use the App responsibly:

• Safety: The App is not a substitute for proper planning, equipment, or judgment. Use at your own risk.
• GPS Accuracy: GPS data may be inaccurate. Do not rely solely on the App for navigation in life-threatening situations.
• Legal Compliance: Obey all local laws, regulations, and land use restrictions when off-roading.
• Environmental Responsibility: Practice Leave No Trace principles and respect protected areas.
• Distracted Driving: Do not operate the App while driving. Pull over safely before interacting with your device.

6. Disclaimers and Limitations of Liability

6.1 No Warranty

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that:

• The App will be uninterrupted, secure, or error-free
• GPS data will be accurate or reliable
• Defects will be corrected
• The App will be compatible with your device or operating system

6.2 Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR USE, ARISING OUT OF OR RELATED TO YOUR USE OF THE APP.

This includes, but is not limited to:

• Personal injury or property damage resulting from App use
• Loss of data stored on your device
• Inaccurate GPS readings or sensor data
• Accidents, injuries, or damages incurred while off-roading, regardless of whether the App was involved

6.3 Assumption of Risk

YOU ACKNOWLEDGE THAT OFF-ROADING IS INHERENTLY DANGEROUS AND INVOLVES RISKS OF INJURY, DEATH, AND PROPERTY DAMAGE. YOU ASSUME ALL RISKS ASSOCIATED WITH OFF-ROAD ACTIVITIES AND USE OF THE APP.

7. Intellectual Property

The App, including its code, design, graphics, logos, and documentation, is protected by copyright, trademark, and other intellectual property laws. All rights not expressly granted to you are reserved by us.

"Offroad Buddy" and associated logos are trademarks. You may not use our trademarks without prior written permission.

8. Termination

We reserve the right to suspend or terminate your access to the App at any time, without notice, for:

• Violation of these Terms
• Fraudulent or illegal activity
• Abuse of community features
• Any reason at our sole discretion

Upon termination, your license to use the App ends immediately. Provisions regarding disclaimers, limitations of liability, and dispute resolution survive termination.

9. Updates and Modifications

9.1 App Updates

We may update the App from time to time to add features, fix bugs, or improve performance. Some updates may be required for continued use of the App.

9.2 Terms Changes

We may modify these Terms at any time. We will notify you of significant changes via the App or email (if provided). Continued use of the App after changes constitutes acceptance of the modified Terms.

10. Third-Party Services

The App may integrate with third-party services, including:

• Apple App Store and Google Play Store (payment processing)
• Cloud service providers (subscription management and Pro features)

Your use of these services is subject to their respective terms and privacy policies. We are not responsible for third-party services.

11. Governing Law and Dispute Resolution

11.1 Governing Law

These Terms, along with our Privacy Policy, constitute the entire agreement between you and us regarding the App.

12.2 Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in full effect.

12.3 Waiver

Our failure to enforce any right or provision of these Terms does not constitute a waiver of such right or provision.

12.4 Assignment

You may not assign or transfer these Terms. We may assign our rights and obligations without restriction.

12.5 Apple Requirements

For iOS users: Apple is not a party to these Terms and has no obligation to provide support or maintenance. In the event of product failure, you may notify Apple for a refund of the purchase price. Apple has no other warranty obligations. Apple is not responsible for addressing claims by you or third parties relating to the App. These Terms comply with Apple App Store Review Guidelines.
